Terms of service

1. Agreement

These Terms of Service form an agreement between you (and the organisation you represent) and SmallBigLeads. If you're accepting on behalf of a company, you confirm you're authorised to bind it.

2. The service

SmallBigLeads is a cloud-based sales CRM. We may add, change, or remove features over time to improve the product. We aim for high availability but don't guarantee the service will be uninterrupted or error-free.

3. Accounts & eligibility

You're responsible for your account, your workspace, your users, and keeping your credentials secure. You must provide accurate information and be legally able to enter into this agreement.

4. Acceptable use

You agree not to:

• Use the service for anything unlawful, or to send unsolicited or unlawful messages.
• Upload or process personal data without a lawful basis to do so.
• Attempt to breach security, disrupt the service, or reverse-engineer it.
• Resell or provide the service to third parties except as expressly permitted.

When you connect outreach or enrichment integrations, you're responsible for complying with the applicable data-protection and anti-spam laws for the contacts you import and message.

5. Subscriptions, trials & billing

• Paid plans are billed in advance on a recurring basis until cancelled.
• Free trials give access to paid features for the stated period; if you don't subscribe, the workspace moves to the free plan or is paused.
• You can cancel anytime; cancellation takes effect at the end of the current billing period. Fees already paid are non-refundable except where required by law.
• We may change pricing with reasonable notice, effective at your next renewal.

6. Your data & ownership

You own the data you put into SmallBigLeads. You grant us the limited licence needed to host and process it to provide the service. We process it in line with our privacy policy, and you can export it at any time. You're responsible for the accuracy and lawfulness of the data you upload.

7. Intellectual property

The SmallBigLeads software, brand, and content are owned by us and protected by law. These terms don't transfer any of our intellectual property to you beyond the right to use the service.

8. Third-party services

The service integrates with third-party tools you choose to connect. Your use of those tools is governed by their own terms, and we're not responsible for them.

9. Disclaimers

The service is provided "as is" and "as available" without warranties of any kind, to the fullest extent permitted by law.

10. Limitation of liability

To the maximum extent permitted by law, neither party is liable for indirect, incidental, or consequential damages, and our total liability for any claim is limited to the fees you paid us in the twelve months before the claim.

11. Termination

You can stop using the service and close your account at any time. We may suspend or terminate access if you breach these terms or to protect the service. On termination, your right to use the service ends and we'll make your data available for export for a reasonable period before deletion.

12. Changes to these terms

We may update these terms from time to time. When changes are material, we'll update the date above and, where appropriate, notify you. Continued use after changes take effect means you accept them.

13. Governing law

These terms are governed by the laws of India, and the courts of India will have jurisdiction over any disputes, unless otherwise required by applicable law.
